These Terms of Use (this "Agreement"), constitute a legal agreement between you ("You" or "you") and beyondClub ("beyondClub/We"), shall govern Your use of and access to the Application (as defined below) and the Website (as defined below).

By using the Platform/Application directly or indirectly and/or checking on any acceptance boxes, You: (a) agree to be legally bound by this Agreement, and (b) represent and warrant to beyondClub that (i) You are of the majority age in your jurisdiction and have the authority to enter into this Agreement (either on your own behalf or by having a parent or legal guardian agree to the terms set forth herein on your behalf) and (ii) this Agreement can be enforced against you and (iii) if You are accepting this Agreement on behalf of an entity, You have the right and authority to agree to this Agreement and this Agreement will legally bind the concerned entity, (iv) You have read and understood, the beyondClub Privacy Policy, the terms of which are posted at the Website and incorporated herein by reference (the "beyondClub Privacy Policy"), and agree to abide by the beyondClub Privacy Policy, and (v) You have read, understood, and agreed to the privacy policy of the Brand (as defined below) you are accessing, the terms of which are posted at the URL provided by the brand partner, and incorporated herein by reference (the "Brand Privacy Policy", and with the beyondClub Privacy Policy, the “Privacy Policy”), and agree to abide by the Privacy Policy, and (vi) You have read, understand, and agreed to the terms and conditions of the brand partner you are accessing’s loyalty program (“Brand Terms of Use”), the terms of which are are posted at the URL provided by the Brand.

We may amend this Agreement from time to time. It shall be Your obligation to check the Agreement for any updates. In the event, You do not agree with any amendments, You may stop using the Website/Platform/Application.

‍1. Purpose‍

The purpose of this Agreement is to set forth the terms and conditions under which, among other things, (i) beyondClub will license to You use of certain of beyondClub's technology, software and/or services such that You can utilize the Application through your internet browser, and (ii) You can access and/or use the Website (collectively, the "Purpose").

beyondClub is not liable for Your interaction with any third-party through the Website/Platform/Application.

‍2. License

beyondClub hereby grants You a non-transferable, non-exclusive, revocable, limited license to access and use beyondClub's application/platform commonly referred to as the “beyondClub Platform" (the "Application/Platform") as made available through its website located at https://beyondclub.xyz (the "Website") during the Term (as defined below) solely for the Purpose.

The Application may be updated from time to time or modified or new versions may be released of the same. These updates may, at the sole discretion of beyondClub, be included in the license as granted to You. You shall not be permitted to sublicense or transfer any of Your rights hereunder including, without limitation, access to the Application.‍

3. Terms governing usage

You represent and warrant that by using and accessing this Platform you represent and warrant that:

1. You shall not copy the features and functionalities of the Platform.
2. Your usage of the Platform is not, either wilfully or otherwise, in non-compliance with any applicable law, rules or regulations. (national, international or local)
3. Your usage of this Platform shall not be in such a manner so as to adversely affect, impair, disable, infect or overburden any of the Platform’s servers, computer systems, networks or any other components which are deployed to provide You a seamless service.
4. Your usage of the Platform shall not interfere with any third-party’s use and enjoyment of the Platform.
5. You shall not modify or alter the content posted or available on the Platform.
6. You shall not without Our express written consent make any use of any trademarks, logos or graphics displayed or used on the Platform for any purpose whatsoever.
7. You shall not use the network of this Platform or the e-mails you may have obtained from this Platform for the purposes of any advertising, promotions or marketing campaigns.
8. You shall not host, display, upload, modify, publish, transmit, store, update or share any information that:
   1. Belongs to another person and to which the user does not have any right.
   2. Is defamatory, pornographic, obscene, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force.
   3. Is harmful to children.
   4. Infringes any patent, trademark, copyright or any proprietary rights.
   5. Violates any law for the time being in force.
   6. Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact.
   7. Impersonates another person.
   8. Contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
   9. Is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

We reserve the right to disable access or completely remove such data/information, that is in breach of the aforementioned restrictions.

If you are found violating any of the aforementioned restrictions, You agree that, it will be a just and fair action on Our part to initiate legal proceedings against you.

‍4. User Obligations

You shall be solely liable for:

1. the authenticity and veracity of all the content posted by You
2. The suitability and appropriateness of the content posted by You
3. Ensuring that the content posted is in compliance with applicable laws.
